Data Strategy Briefing — August 15, 2022

Vietnam issued Decree 53/2022 guiding the Cybersecurity Law, activating data localisation and office establishment duties for foreign digital service providers handling Vietnamese user data.

Executive briefing: The Vietnamese government promulgated Decree 53/2022/ND-CP on 15 August 2022, detailing cybersecurity obligations for domestic and foreign enterprises. Beginning 1 October 2022, platforms that collect, exploit, or analyse Vietnamese users' data must store specified categories of personal, relationship, and behavioural data in Vietnam and establish a local presence when ordered by the Ministry of Public Security.

Key localisation checkpoints

  • Data mapping. Identify Vietnamese user datasets covered by Articles 26 and 27, including customer identity records, service usage logs, and payment information.
  • Infrastructure planning. Determine whether workloads can be hosted in-country via dedicated data centres or authorised cloud regions that meet localisation requirements.
  • Order response. Prepare for potential localisation or representative office orders by defining responsible entities, documentation packages, and compliance timelines.

Operational priorities

  • Policy alignment. Update data retention, breach notification, and content moderation policies to reflect the decree's security audit and takedown provisions.
  • Vendor oversight. Ensure third-party processors supporting Vietnam operations can deliver localisation evidence and cooperate with law enforcement requests.
  • Risk assessments. Embed Decree 53 controls into enterprise risk assessments covering APAC localisation mandates and cross-border transfer governance.

Enablement moves

  • Establish a localisation project office coordinating infrastructure, legal, and policy teams for Vietnam compliance.
  • Develop bilingual compliance playbooks addressing Ministry of Public Security inspections and incident reporting.
