Canada Opens Consultation on AIDA Regulations

On 4 March 2024 Innovation, Science and Economic Development Canada (ISED) launched the first regulatory consultation for the Artificial Intelligence and Data Act (AIDA). The consultation paper outlines how Canada intends to operationalize AIDA once Bill C-27 passes: it proposes definitions of “high-impact” systems, baseline obligations for all AI developers and deployers, mandatory risk management, transparency and incident reporting requirements, and enforcement mechanics for the Office of the Artificial Intelligence and Data Commissioner (AIDC).

Stakeholders have until 4 May 2024 to respond. The consultation precedes publication of draft regulations in the Canada Gazette and provides a roadmap for teams to assess readiness. Enterprises operating AI systems in Canada—or serving Canadian clients—should review the proposals, identify impacted products, and prepare governance improvements spanning data management, algorithmic accountability, and documentation.

High-impact system definition

ISED proposes eight indicative categories for high-impact AI systems, including: (1) biometric identification and inference; (2) systems that make or support employment decisions; (3) systems that determine access to essential services such as credit, housing, or social benefits; (4) systems used in education or career training evaluations; (5) systems that influence legal determinations or law enforcement; (6) systems that assess eligibility for healthcare; (7) systems controlling physical infrastructure where malfunction could cause significant harm; and (8) systems that materially influence individuals’ behavior at scale (for example, recommender systems with broad reach).

High-impact classification would trigger improved obligations even when models are supplied by third parties.

The consultation contemplates exemptions for research, national security, and systems already regulated under equivalent sectoral frameworks (for example, medical devices) provided duplicative regulation is avoided. However, AIDA would still impose coordination requirements to ensure consistency across regulators.

Proposed obligations

  • Risk management programs. High-impact system deployers must maintain documented risk management frameworks that identify foreseeable harms, assess severity and likelihood, and implement mitigation controls. These programs must be reviewed at least annually and before major system modifications.
  • Data governance. Developers and deployers must describe datasets used for training, validation, and testing; document data provenance; ensure representativeness; and address known biases. For synthetic data, documentation must show generation methods and validation checks.
  • Testing and monitoring. High-impact systems require pre-deployment testing, ongoing monitoring, and incident response plans. Deployers must establish thresholds for performance degradation and take corrective actions when metrics fall outside acceptable ranges.
  • Transparency and notices. Individuals interacting with high-impact systems must receive clear disclosures that AI is involved, along with explanations of outputs and avenues for human review. Teams must also publish plain-language statements describing system purpose, limitations, and mitigation strategies.
  • Record keeping. Developers and deployers must maintain logs of design decisions, datasets, testing results, risk assessments, and incident reports for prescribed retention periods. Records must be accessible to the AIDC upon request.
  • Incident reporting. Material incidents—such as systemic bias, safety failures, or privacy breaches—needs to be reported to the AIDC and impacted teams within prescribed timelines (for example, 72 hours for serious incidents) and accompanied by remediation plans.
  • Accountability. Teams must designate responsible senior officials, ensure appropriate training, and integrate AI governance into existing compliance structures (privacy, cybersecurity, ethics).

Interaction with international regimes

ISED positions AIDA as interoperable with the EU AI Act, US Executive Order 14110 setup, and OECD AI Principles. Multinationals should map obligations across jurisdictions to reuse controls where possible. For example, risk management steps under NIST’s AI Risk Management Framework can inform AIDA compliance, while documentation developed for the EU AI Act’s technical files may satisfy Canadian record-keeping expectations.

Governance priorities

Boards and executive committees should receive briefings on AIDA’s scope and proposed enforcement powers—including administrative monetary penalties up to the greater of C$10 million or 3% of global revenue for certain contraventions. Establish AI governance councils that integrate legal, compliance, product, privacy, cybersecurity, and ethics expertise. Assign responsibility for AIDA compliance to a senior officer who can coordinate cross-functional efforts and report to the board.

Teams should maintain AI system inventories capturing purpose, datasets, risk assessments, monitoring metrics, and human oversight details. Link these inventories to privacy impact assessments (PIAs), security threat models, and model cards to create a complete documentation repository.

Adoption timeline

  1. Immediate (Q1 2024): Review the consultation paper, identify impacted systems, and submit feedback to ISED. Participate in industry associations (for example, the Business Council of Canada, Responsible AI Institute) to shape final regulations.
  2. Short-term (Q2–Q3 2024): Develop AI governance policies describing classification criteria, approval workflows, and documentation standards. Launch pilot risk assessments for high-impact candidates, capturing data lineage, algorithm design choices, and mitigation controls.
  3. Medium-term (Q4 2024–2025): Implement technical controls—such as bias testing pipelines, model monitoring dashboards, and human-in-the-loop override capabilities. Train staff on incident reporting, documentation, and transparency obligations. Integrate AI governance metrics into enterprise risk dashboards.
  4. Long-term (post-enactment): Once AIDA is in force, operationalize certification and attestation processes, prepare for AIDC inspections, and maintain ongoing compliance evidence. Update governance frameworks as additional regulations (for example, for general-purpose AI models) are released.

Documentation and evidence

AIDA will require demonstrable documentation. Teams should create technical dossiers for high-impact systems, including system descriptions, risk assessments, evaluation datasets, performance metrics, and change logs. Establish version control for documentation to ensure historical traceability. Use model cards and system cards to communicate key attributes to teams.

Data privacy and security alignment

AIDA complements Canada’s Consumer Privacy Protection Act (CPPA) proposals. Ensure privacy impact assessments cover AI-specific data uses, including synthetic data handling, de-identification methods, and consent management. Cybersecurity teams should integrate AI systems into threat monitoring, protecting model artifacts, training data, and inference endpoints from adversarial attacks. Implement access controls, encryption, and audit logging consistent with Treasury Board and NIST guidance.

Third-party management

Many teams rely on third-party AI services. Contracts should mandate compliance with AIDA obligations, grant audit rights, require incident notification, and require data handling practices. Maintain due diligence checklists covering model risk, bias mitigation, security, and documentation. For open-source models, document provenance, licensing terms, and modifications.

Metrics and monitoring

Define key risk indicators such as number of high-impact systems, completion rate of risk assessments, time to remediate incidents, false-positive/false-negative rates, and fairness metrics across protected classes. Report these metrics to governance bodies to enable preventive oversight.

Preparing for enforcement

The AIDC will have inspection, audit, and order-making powers. Teams should design playbooks for regulatory inquiries, including document production, interviews, and remediation tracking. Maintain evidence demonstrating compliance with ministerial orders, if issued. Establish escalation paths for potential criminal offenses (for example, knowingly causing serious harm through AI deployment).

Follow-up actions

Monitor ISED communications for summaries of consultation feedback and the timeline for draft regulations. Engage in subsequent consultations, especially those focused on general-purpose AI models and harmonization with provincial privacy commissioners. Early adoption of risk management, documentation, and transparency practices will reduce compliance friction when AIDA enters into force.
